INTRODUCTION

 

The Crime against Woman and Children (Prevention) Cell, Ludhiana was constituted on 10.09.2001 with the whole hearted efforts of then Senior Superintendent of Police Sh. H.S. Sidhu, IPS. The formal inauguration of this cell was held on 29.06.2002 by Hon'ble Justice Sh. V.K. Khanna, Chairman, and Punjab State Human Rights Commission, Chandigarh in a function held at Wheat Bhawan, PAU , and Ludhiana . Sh. A.P. Bhatnagar, IPS Additional Director General of Police, PSHRC, Sh. K.K. Attri, IPS, Inspector General of Police, Crime, Punjab and all the districts Senior Superintendent of Police also attended this function.

The CAW & C Cell, Ludhiana comprises a team of 12 police officers and 24 civilian members from diverse backgrounds viz academicians, lawyers, home workers, businessmen, industrialists, professional, psychologists and retired government officials. There are Three Counseling Room and 12 counseling panels. Each panel has 2 non police members and 1 serving police officer.

The CAW & C Cell, Ludhiana celebrated the successful performance of the Cell after completion of its first year on 10.09.2002. Sh. Mohammad Mustafa, IPS, then Deputy Inspector General of Police, Ludhiana Range , and Ludhiana was the Chief Guest of the function held at Police Lines, Ludhiana . Sh. H.S. Sidhu, IPS, Senior Superintendent of Police, Ludhiana , other senior police officers and members of the CAW & C Cell also attended the function.

The 2nd and 3rd Anniversary of this Cell was celebrated on 27.09.2003 and 10.09.2004 respectively at GO's Mess, Police Lines, and Ludhiana . Sh. Narinder Pal Singh, IPS, Senior Superintendent of Police, Ludhiana was the Chief Guest of this function.

Under the direction of Sh. A.S. Rai, IPS, Senior Superintendent of Police, Ludhiana , all the existing Panels have been reconstituted from 22.07.2006 comprising of qualified member and police officials duly trained by police department.

Due to the satisfactory and effectiveness of the policy of the cell, The ISO-9000-2001, Prestigious Institution of India has awarded Certificate of Quality Counseling in 19-11-2007 for its friendly service to all Law abiding Citizen and conducting of involved parties to minimize conflicts.

All complaint which are referred by the Senior Authorities for conducting inquiry related to dowry demand, tortured and harassment by the in-laws, which are found to be correct by the Panel Members are recommended for Registered of FIR. All these cases have been investigated by the Investigating Officers, Posted in the Cell. About cases are investigated by the cell till date.

The Cell has received 13484 complaints till date, out of which 13198 have been disposed of from these 5533 resulted in reunion, 2295 resulted in divorce with mutual consent, 376 resulted in registration of FIR and 4994 complaints have been filed. The successful performance of the Cell and its reputation for fair and impartial enquiry has attracted application from all sections of the society. Even persons from neighboring states are seeking counseling service being provided by the cell.


Functioning of Crime Against and Women & Children (Prevention) Cell, Ludhiana

 

A Crime Against Women & Children Cell in Ludhiana District is a collaboration between District Police officers, counselling professionals and volunteers from the society. This Police Counselling Cell works under the supervision of Sh. Ishwar Singh, IPS, Commissioner of Police, Ludhiana .

This cell consists of 12 counselling Panels. Each panel consists of 3 members, one Police NGO/HC and two volunteers from the public. All the members of the counselling cell have been trained in counselling skills. There are training programmes in counseling skills every 3 months or so. The Senior Police officer associated with the counseling cell meets the counselling cell members to discuss problems and supervise the functioning of the CAW & C Cell.

Any woman who approaches Police Officers for any crime, violence physical & mental torture of dowry demand is interviewed by the members of a counselling panel, using counseling skills of empathy and active listening. During first 2-3 counselling sessions, she expresses her problems and emotional distress and is given emotional support. During this period other associated family members like husband-in-laws, her parents or any other significant relatives are inter viewed and the problems faced by her are evaluated . During next counseling session problem solving processes are applied & the victim is helped in working through her problems through police as well as counselling process. Urgent cases are tackled immediately. Finally, efforts are made to improve marital and family relationships in order to prevent future crimes and hurt to the dignity of the women. Immediate police help is provided to the victim where ever needed.

If the marriage is not found to be safe for the woman the efforts are made to achieve a marital consent, separation & divorce. One young girl was married to a schizophrenic man who was taking drugs and tried to kill her one night because he had delusion about the wife. She was saved by the neighbours & then she applied to CAW Cell. On evaluation of the marriage it was found that her husband was not earning, she was mentally ill & there were no support which could help getting him treated. Through negotiation a mutual consent divorce was achieved. Otherwise it would have taken then many years to get legal divorce & the woman would have suffered further harassment besides financial problems of carrying on a court case.

In another case, the woman was being beaten by her husband due to conflicts with her mother-in-law & she was suffering physical violence. She was mother of two children and family violence was also affecting the psychological health of the children. She was living with her parents now . In this case counselling process was used to improve the relationship between husband & wife. Also, her relationship with her mother-in-law improved after counselling of the lady & her mother-in-law. Then the marriage was saved & she went back to her husband. Follow up counselling session are held for each saved marriage in order to help the women feel safe protected and to strengthen family relationship further.

The CAW police Cell team consists of Commissioner of Police, Deputy Commissioner of Police and Assistant Commissioner Police, & volunteer members from public.

It is suggested that such counselling cell for handling CAW should be started in all the Districts all over the country where counseling skills are used to give psychological support to victims of crime & to help them in facing the problem of marriage and family.


OBJECTIVES

 

 

·                 To protect the rights of women and children.

 

·                 To counsel victims of matrimonial disputes and family disputes free of cost. The objective is to amicably resolve the dispute without compromising on the rights of the victim.

 

·                 To test the veracity of allegations leveled by the complainant and recommend appropriate legal action.

 

·                 To prevent commission of future crimes especially cases related to matrimonial violence and wife battering.

 

·                 To counsel victims of crime and help them in recovering from their traumatic experiences.

 

·                 To strengthen police community relations.
